1. Agreement to Terms
By accessing or using our services at boreal.chat (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.
These Terms apply specifically to the official hosted version of boreal.chat. If you are running a self-hosted instance, your use is governed by the PolyForm Noncommercial License 1.0.0, and you are responsible for your own instance.
2. Use of Our Services
2.1. Eligibility
You must be at least 18 years old to use the Service. By agreeing to these Terms, you represent and warrant to us that you are at least 18 years old.
2.2. User Accounts
You are responsible for safeguarding your account and for all activities that occur under it. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.
2.3. Acceptable Use
You agree not to misuse the Service or help anyone else to do so. This includes, but is not limited to:
- Violating any applicable laws or regulations.
- Generating or sharing content that is illegal, harmful, abusive, or that infringes on the rights of others.
- Attempting to disrupt or compromise the integrity or security of the Service, including scraping, reverse-engineering, or decompiling the services.
3. User Content
You retain ownership of all intellectual property rights in your prompts, conversations, and other content you create in the Service ("User Content").
To the extent necessary to provide and maintain the Service, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and process your User Content. For example, we need this license to store your conversations and send them to third-party AI providers to generate responses.
4. Fees and Payment
Some parts of the Service are billed on a subscription basis. You will be billed in advance on a recurring, periodic basis. All payments are handled by our third-party payment processor, Stripe. We are not responsible for any fees, taxes, or other charges that may be imposed by your bank or credit card issuer.
5. Third-Party Services
The Service integrates with third-party AI model providers (e.g., via OpenRouter) to deliver its functionality. You acknowledge that the AI-generated output may not always be accurate or reliable. We are not responsible for the availability, accuracy, or content provided by these third-party services.
6. Termination
You can stop using the Service and terminate these Terms at any time by deleting your account. We may suspend or terminate your access to the Service at any time, with or without cause or notice, for any reason, including if you breach these Terms.
7. Disclaimers and Limitation of Liability
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL BOREAL.CHAT, ITS AFFILIATES, OR THEIR LICENSORS, SERVICE PROVIDERS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
8. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the European Union, without regard to its conflict of law provisions.
9. Changes to Terms
We reserve the right to modify these Terms at any time. If we make material changes, we will provide you with notice, such as by sending an email or displaying a notice within the Service. Your continued use of the Service after any changes constitutes your acceptance of the new Terms.
